that KNOW how much deed restrictions protect property values.
It could eventually affect neighborhoods other than King's Grant if it
sets a precedent in the courts.

As most of you know, I am the President of the King's Grant Homeowner's Association. The homeowners' of King's Grant are about to begin the battle of our lives. This battle is not about saving the golf course, but rather it is about protecting the restrictive covenants placed on the land. Over 30 years ago the developer of King's Grant placed a restriction on approximately 178 acres of land which states the property must remain a golf course, swimming pool, clubhouse, and tennis courts. Many of you also have the same type of restrictive covenants placed on the community in which you live. Imagine living on a golf course, looking out your back window at beautiful green land one day and the next day staring at the windows of another house. Imagine having a beautiful horse farm next door and the next day it has 100 houses on it. No more sounds of horses, but rather, the fumes and noise of vehicles! That is what we now face - 300+ homes right in the middle of a well established, simple neighborhood. The loss of these covenants would adversely affect not only our local area, but also the state, and the entire nation should we fail to win this battle.

The Board at King's Grant has not sat by silently watching the course deteriorate. The course was purchased in August of 2002 and we began trying to work with the current owners in January of 2003 to no avail. In September of 2004 we filed a law suit against the course detailing their failure to abide by the covenants. This case is still on the dockets; however, they are going to declare bankruptcy. Their intent is to ask the bankruptcy judge to set aside the covenants and allow them to do with the land as they please. We will fight this effort with everything we have. Unfortunately, this fight takes money and herein lies our problem. We do not know who is backing them with the legal funds they are expending but no matter, no attorney works for free so they are getting money from somewhere. We on the other hand are normal folks like each of you.

The large majority of our residents are retired and many are now elderly. We are currently raising funds voluntarily throughout the neighborhood. We also have held a neighborhood garage sale which raised $3,600. We could have a non-voluntary one time assessment but that is precisely what the club owners have used as a part of their scare tactics and therefore we would like to avoid such if possible.

Plain and simple - we need your help! If you, your neighbors, your association, your friends and family can help us in any way, please help. Be it $5 or $500, we would be grateful. In helping us, you will help preserve the covenants assigned to your property, the Ashley River, and the Historic District in which we reside.
